Terms of Service — Biemo

1. Acceptance of terms

By creating an account or using Biemo (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all users including learners, parents, and administrators.

2. Description of service

Biemo is an AI-powered educational platform aligned to the South African CAPS curriculum. We provide lessons, practice quizzes, AI tutoring, and progress tracking for learners in Grades 4–12.

3. Accounts and registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You may not share your account with others or create accounts on behalf of third parties without their consent.

Learners under the age of 13 may only use the Service with verified parental consent. By registering a learner account, you confirm that the required consent has been obtained.

4. Subscriptions and payments

Biemo offers a Free plan and a paid Pro plan (R99/month). Payments are processed securely via PayFast. Your Pro subscription renews automatically each month. You may cancel at any time from your account settings — access continues until the end of the current billing period.

All prices are in South African Rand (ZAR) and are inclusive of any applicable taxes. We reserve the right to change pricing with 30 days' notice.

5. Acceptable use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorised access to any part of the platform
Upload harmful, offensive, or misleading content
Reproduce or redistribute our content without written permission
Interfere with the operation of the platform or other users' experience

6. Intellectual property

All content on the Service — including lessons, quizzes, AI-generated explanations, and platform design — is owned by or licensed to Biemo. You may use this content solely for personal, non-commercial learning purposes.

7. AI-generated content

Biemo uses AI models to generate explanations, hints, and learning recommendations. While we work to ensure accuracy and alignment with the CAPS curriculum, AI-generated content may occasionally contain errors. It is not a substitute for qualified teaching. Parents and learners should use their judgement when relying on AI-generated explanations.

8. Limitation of liability

Biemo is provided “as is”. We do not guarantee that the Service will be uninterrupted, error-free, or that outcomes such as improved grades will result from use of the platform. To the maximum extent permitted by South African law, we are not liable for indirect or consequential losses arising from use of the Service.

9. Termination

We may suspend or terminate your account if you breach these terms or if we have reasonable grounds to believe your use of the Service harms other users or the platform. You may delete your account at any time from your settings.

10. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
